2) how much he is injured

and then he estimates the legal claims that can be made on his client  by law and assess the strenth of that case.

A lawyer can also decline to take case if he believes that it is tresspassing the rules of law and there can not be made any legal claims on that case.

There are number of ways how can actually a lawyer can be paid . one of the most common is contingency fee. It means that lawyer will be paid on a favourable result. In this method Lawyer earns some percentage of client 's fund provided by law only if case is successful .
